The Cinematic Hub: Terms and Conditions (T&Cs)
While these comprehensive Terms and Conditions (T&Cs) outline the framework of our agreement, we strongly encourage all clients to review and sign a formal Client Service Agreement for every project. This ensures additional security and peace of mind for both parties, allowing for specific terms tailored to your unique needs. By booking our services and signing the formal agreement, your working relationship with The Cinematic Hub is clearly defined and documented for a smooth, professional collaboration.
Core Terms
1. Booking and Cancellation:
A non-refundable 50% deposit is required to secure your booking and reserve the date. Cancellations made less than 72 hours before the scheduled event will result in forfeiture of the deposit.
2. Payment Schedule:
The remaining 50% balance is due before the final product (images/video content) is shared with the client.
3. Ownership and Licensing:
We grant you exclusive, worldwide, royalty-free rights to use, reproduce, distribute, and publicly display the final product for personal or commercial purposes. The Cinematic Hub retains the right to use the final product for promotional and marketing purposes.
4. Travel Expenses:
You will be responsible for covering all travel expenses incurred during the project for travel fees above R65, including transportation, lodging, and any other related travel costs.
5. Liability:
We are not liable for any injury, loss, or damage to persons or property during the event or project. It is your responsibility to ensure proper permissions and permits are obtained for your chosen locations.
6. Privacy:
We respect the privacy of our clients and will not share any personal information or images that infringe on the privacy of our clients or contain personal information or identifiable images without prior consent.
7. Final Product Delivery:
We commit to the timeline outlined in your specific package (e.g., Standard 4-7 business days, Priority 1-3 business days), depending on the project's complexity. The guaranteed delivery date will be confirmed in the formal Client Service Agreement.
8. Backup and Data Loss (Refined):
We strive to maintain multiple backups of all data and photographs (as detailed in our FAQ). However, in the rare event of catastrophic data loss or corruption before final delivery, our liability is strictly limited to a 50% refund of all fees paid by the client to date, which constitutes the half extent of compensation.
9. Force Majeure:
We are not responsible for any failure or delay in performance due to circumstances beyond our control, such as acts of God, war, riots, strikes, epidemics, or compliance with any law or government order.
10. Dispute Resolution:
Any disputes arising from this agreement shall be governed by the laws of South Africa and resolved through negotiation, mediation, or arbitration before resorting to legal action.
11. Behind-the-Scenes Marketing Content:
Clients acknowledge and agree that The Cinematic Hub may record behind-the-scenes (BTS) footage during projects for marketing and promotional purposes. By booking our services, clients consent to their potential appearance in such BTS content.
12. Updates to Contract, Disclaimer, and Policies:
The Cinematic Hub reserves the right to modify or update this contract, disclaimer, and our company policies at any time without prior notice. It is the client's responsibility to review and stay informed about any changes. The most up-to-date versions of these documents will be available on our website or upon request. By continuing to use our services after any updates, the client agrees to be bound by the revised terms.
